Agreement to Terms

These Terms and Conditions ("Terms", "Terms and Conditions") constitute a legally binding agreement between you ("User", "you", or "your") and Jobally ("Company", "we", "us", or "our") concerning your access to and use of the Jobally mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.

1. License and Access

1.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Access and use the App for personal, non-commercial purposes

1.2 License Restrictions

You agree NOT to:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the App
• Use automated systems (bots, scrapers) to access the App
• Sell, rent, lease, or sublicense the App
• Use the App to compete with our business

1.3 Updates and Modifications

We reserve the right to:

• Modify or discontinue any feature of the App
• Release updates and require you to install them
• Change these Terms at any time with notice

2. Account Registration and Security

2.1 Account Creation

To use certain features, you must:

• Create an account with accurate information
• Be at least 16 years of age
• Provide a valid email address
• Create a secure password
• Maintain the confidentiality of your account credentials

2.2 Account Responsibility

You are responsible for:

• All activities that occur under your account
• Maintaining the security of your password
• Notifying us immediately of any unauthorized access
• Any losses resulting from unauthorized use of your account

2.3 Account Termination

We may suspend or terminate your account if:

• You violate these Terms
• You provide false or misleading information
• Your account is inactive for an extended period
• Required by law or for legal reasons

You may delete your account at any time through the App settings.

3. Subscription and Payment Terms

3.1 Free Version

The App offers a free version with basic features including:

• Job application tracking
• Contact management
• Interview scheduling
• Basic statistics and notifications

3.2 Premium Subscription

Premium features include:

• AI Resume Checker
• AI Cover Letter Generator
• Cloud Sync across devices
• CSV Import/Export
• PDF Report generation
• Advanced analytics
• Priority support

3.3 Payment

• Subscriptions are processed through Google Play Store or Apple App Store
• Payment is charged to your app store account
• Prices are displayed in the App and may vary by region
• All sales are processed by the respective app store (Google/Apple)

3.4 Billing Cycle

• Subscriptions automatically renew unless cancelled
• You will be charged at the start of each billing cycle
• Billing cycles may be monthly, yearly, or other periods as offered
• Cancellation takes effect at the end of the current billing cycle

3.5 Cancellation and Refunds

• You can cancel your subscription anytime through your app store account
• Cancellation prevents future charges but doesn't refund current period
• Refund requests are handled by Google Play or Apple App Store per their policies
• We do not process refunds directly

3.6 Free Trials

• Free trials may be offered for Premium features
• You will be charged when the trial period ends unless you cancel
• Only one free trial per user
• Must cancel before trial ends to avoid charges

3.7 Price Changes

• We reserve the right to change subscription prices
• You will be notified at least 30 days before price changes
• Continued use after price change constitutes acceptance
• You may cancel if you don't agree to new pricing

4. User Content and Data

4.1 Your Content

You retain ownership of all content you submit to the App, including:

• Job application data
• Contact information
• Resumes and cover letters
• Notes and comments

4.2 License to Use Your Content

By submitting content, you grant us a license to:

• Store and process your content to provide services
• Use aggregated, anonymized data for improvements
• Process content through third-party AI services (OpenAI) for AI features
• Backup and sync your data (Premium feature)

4.3 Content Responsibility

You are responsible for:

• The accuracy of information you provide
• Ensuring you have rights to upload any content
• Any consequences of sharing sensitive information
• Backing up important data outside the App

4.4 Prohibited Content

You may not upload content that:

• Violates any law or regulation
• Infringes on intellectual property rights
• Contains malware or harmful code
• Is fraudulent, false, or misleading
• Harasses, threatens, or harms others

4.5 Data Backup

While we perform regular backups:

• You should maintain your own backups of important data
• We are not liable for data loss
• Use Export features (CSV/PDF) to backup your data

5. AI-Powered Features

5.1 AI Resume Checker and Cover Letter Generator

When using AI features:

• Your content is sent to OpenAI for processing
• AI-generated content is provided "as is"
• Results are suggestions, not guaranteed outcomes
• You are responsible for reviewing and editing AI output

5.2 No Guarantees

We do not guarantee that:

• AI recommendations will improve your job search success
• Generated cover letters will result in interviews
• Resume analysis will lead to job offers
• AI output is error-free or complete

5.3 Third-Party AI Service

• AI features use OpenAI's services
• Subject to OpenAI's terms and policies
• We are not responsible for OpenAI service availability
• AI features may be limited or unavailable at times

6. Acceptable Use Policy

6.1 Permitted Use

The App is for personal use to:

• Track your own job applications
• Manage your professional contacts
• Schedule your interviews
• Organize your job search

6.2 Prohibited Activities

You may not:

• Use the App for commercial purposes without permission
• Share your account with others
• Create multiple accounts to circumvent limitations
• Attempt to circumvent Premium features
• Use the App to spam or harass others
• Collect data about other users
• Interfere with the App's operation
• Violate any applicable laws

7. Intellectual Property

7.1 Our Rights

The App and its content (excluding your user content) are owned by us and protected by:

• Copyright laws
• Trademark laws
• Other intellectual property rights

This includes:

• App design and code
• Logos and branding
• UI/UX elements
• Documentation

7.2 Trademarks

"Jobally" and associated logos are our trademarks. You may not use them without our written permission.

7.3 Feedback

If you provide feedback, suggestions, or ideas:

• We may use them without obligation to you
• You grant us unlimited rights to such feedback
• No compensation is owed for feedback

8. Third-Party Services and Links

8.1 Third-Party Services

The App integrates with:

• Supabase: Authentication and database
• OpenAI: AI features
• RevenueCat: Payment processing
• Google Play Services: App distribution

Each service has its own terms and policies.

The App may contain links to third-party websites or services:

• We are not responsible for external content

• Access external links at your own risk

9. Disclaimers and Limitations

9.1 "As Is" Service

9.2 No Job Placement Guarantee

We do not guarantee:

• That you will get a job using our App
• Interview callbacks or job offers
• Success in your job search
• Accuracy of AI-generated content

9.3 Limitation of Liability

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the App
• Your content or data
• Your violation of any rights of others
• Your violation of any laws

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

• Using the "Delete Account" feature in App settings
• Contacting us at contact@sotopatrick.com
• Uninstalling the App

11.2 Termination by Us

We may terminate or suspend your access immediately if:

• You breach these Terms
• We are required to do so by law
• The App is discontinued
• Your account is inactive for extended period

11.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• Your data may be deleted after a grace period
• Subscriptions continue until end of billing cycle
• You must stop using the App
• Certain provisions survive termination (indemnity, disclaimers, etc.)

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

No agency, partnership, or joint venture is created by these Terms.

We are not liable for failure to perform due to circumstances beyond our reasonable control.

16.3 Acceptance of Changes

Continued use of the App after changes constitutes acceptance. If you don't agree to new Terms, stop using the App.
